Using music and commercial rights

So... I'm in a huge bind here:

Frakking youtube...
I use a 5 second music clip from a personal friend's Band. I Also try and plug them whenever... but now youtube is blocking my monetization on new videos untill I provide with proof of usage.
The biggest promo I did of his band was instantly flagged and monetization removed. (and I cant use it as a channel ad, bohooo).

Anyone know if this auto-flagging will trickle down to the vids I have already uploaded? I'd be pretty pissed if suddenly all my vids stopped being monetized...

I do NOT want to change my intro music, as it is a plug to his band (and they are actually good!), and its part of the "branding". In fact, one of the things I always wanted to do from the start until.... forever, was to have that specific intro music, start all the vids with "Hi, I am CagerOnTwoWHeels and ..." and end with "Cager out!", and then the music.

So if they decide to un-monetize cause of that clip, I'm fudged.

Legalwise, my friend (hes the lead singer and composer) might also have a bit of an issue. He ceded the management of the rights to the songs to a company called "CD Baby", and his own videos, on the band's official channel get flagged too. Carpet Bombing FTW?

I do NOT want to have him sign a paper for every singly freaking vid I have.
I might, if he agrees, deliver them a pdf with a list of URLs to all vids, and to the channel and saying I can use it, with his signature on it? Would that work? Thing is, is HE the rights holder, or is it CD Baby?

Did your mate and the other band members get some money from CD Baby for signing over the rights? Did they retain any rights in that contract to use the music commercially or allow others to do so? Do you have the full band's agreement to use the music or even written permission from your friend alone?

I don't blame YouTube here - they have been pressured by the music industry to stop illegal usage of copyright material else face legal action, and their terms and conditions are pretty clear. You have been caught in that crossfire.

Looks like you have been caught by a bot,but if CD Baby now find this post from a Google search and then decide to flag each of your videos for copyright violation with YouTube, you will lose all monetisation on all videos flagged. At the moment you are getting away with it

I have contacted CDbaby (via appealing the only video where they rejected my copyright claim - as in, yt flagged it as belonging to cdbaby, I appealed and said "I know Paulo, he says its ok", and they rejected - for only that particular video, having said "ok" previously on other vids), to basically ask for more details on if its ok or not, and exactly how its ok.
 
Well... CDbaby release the copywrite claim on the video. But if youtube decided to flag any other vids cause of the audio, I am not quite sure how to proceed. Ill go on a case-by-case basis....
 
Im sick of YT really, Seems that the monetized vids have probs, but the un-$ ones have NO issue. Not like im making ANY MONEY from these vids YT!!!!!
Ive even had msg's saying a song cant be used, and the song they name is the WRONG Name/Lyrics/Content that ive used, but still after 3msg's they STILL reckon its the same song, AAARRRRRRRGGGGGGGHHHHHHHHHHHH??
Just wish they had a button that said 'Click if your NOT expecting to make Gazzillions', coz seriously, the BIGGEST Sub ppl here, wouldnt be making $$ from the music in the background, its from the content THEY put in!!!!

Ive got a NEW msg from YT today, apparr a song i used 'Might' be licensed? I only put this video up 4Months ago!!! Great, WTF do u 'Reveiw' when we are uploading YT??????
I can understand the 'Protection' for artists work, but if they put it up for FREE NON-Commercial Use, ona FREE for use site, then i CANT use it for those reasons, coz apparr im making Buckets of money? NOT!!

I did have the thought of going to an 'Un-Signed' band, see if they can write me some music, but if im gunna have probs just coz the Band doesnt do all the Copyright+Legal shit?? Why bother?
Their is NO FREEDOM of anything today :( I can point my camera, film and i OWN it, BUT if i point it at a police officer, then apparr im 'Impeding on police activity' WTF!!!!!!!!!!!!!!


Tough break on the mates band CAGER, seems that even though we are all Free todo/think/etc, we are not really free till we check it with someone else lol

Seriously I am glad I'm not monetized and never intend to be either.
YT/Google couldn't run the water out of a wellington boot if the instructions were on the bottom...

Why bother monetizing to get shit-all money and lots of crap?
Are there any other benefits of monetizing other than the money? (Serious question, I really don't know).

Besides this I use all my own music, so I guess not such a big issue for me, they'd get a fkload of Belfast language from me if they tried to interfere with that, lol.
But I have heard so many complaints similar to yours mate, so why not just feck them off with their monetizing rules and incompetence and do what you love doing and others love watching? ;)
 
Main reason i 'monetize', is coz, ina way im 'Copyrighting' MY vids, content, etc.
Dont wanna see my vids on some friggn 'Funniest home vids' or some shite like that. (Ive heard it happens coz YT is 'Open veiwing' or some crap? The networks dont pay and DONT owe u diddly squat?)
Not fair when we are 'fighting' to get Free, Un-Copyrighted music, even original music MADE for some of us is only to find someone objects or owns the rights for it, and wants their $10 to put with the other MILLIONS!!

So if anyone wants to use my 'Open-share/veiwing vids that I MADE/ I Captured/ I did ALL the work. Well, they can pay and one-day, i 'might' see 5c? :rolleyes:
BUT, Vids like the one with RidingwithTom & ARidersLife, i dont monetize, coz i dont wanna get fame/subs/veiws from the success of others.

Kinda see the 'Protected music' issue, BUT ima ABSOLUTE 'TightAss', so its my perogitive!! ;)

My friend has his own band ive used his music over my vids on a couple of occations if im having bad wind noise or ect, ive had no issues with monetizing all i do is add on discription that x owns the music on the video and i have rights to play this then i add a link to his band page and music download ect...

Had no issues touch wood..
 
Im going to formalize everything with my friend. To be fair, I will be paying 25% of income to him, on videos that feature the band's music.
And he added the caveat that only videos that feature more than 30 seconds (or a significant portion) of a song qualify for this, so I can still use my intro song. Thats fair enough, and I' very happy with the end result.

Now... youtube keeps happily saying it cant verify my claim to the copywright on 2 videos:
One is "Black Suit Zombie", the other is "5k Subs! Thank you!".

My friend band's music (the whole music). Had a copyright claim by "CD BABY", that was after I argued, RELEASED.
Then comes youtube and goes "ooohhh we cant verify that". :D I argued that since the youtube owner of the rights release the copyright, that is about as much proof as they should need. No answer so far, a couple of weeks later.

5k Subs:
I used the youtube free to use music ("Engine Fire"), so that's just retarded. I called them retarded on my arguing. And asked if they employ drunk people.
I might have overdone it a bit.
I might have been slightly drunk at that time.

Also no answer so far.

Its good reference tho? Has some of the Legalities in it, bit of learning.

Bad side is, The amount of Vloggers just in MV, and the Few tracks on YT to use, we'd be hearing the music 'Loop' in no time :(

Yey! I am now officially, fully licensed! I even got the paper, signed by both music authors, to send to youtube!
This is a milestone - my first "legalese" document needed and obtained!
