At least you came out okay, if not a little bit battered and bruised. It could have been a hell of a lot worse if you didn't slow down as soon as you saw it.
 
Just an update after a couple of lawyers haver looked this over and here is what they say...

The barrier is not illegal but its not legal, sadly there is no strict law on road barriers, the red reflectors are not even that but just red bits of metal nailed onto the posts. So while yes they agree its a extremely dangerous construction there is little point in trying to sue.

Reason, the defence will be I should have come to a complete stop before the barrier before pulling out onto the road, thus not even hitting the barrier. Worse still I could also be done for causing damage to the barrier.

So in short I'm in the hole for about 1500+ for the bike. Not as bad as I thought but ouchie. :cry:

£1500 repairs!?!?! Blimey. I wish I could afford to pay that to get my bike fixed up having dropped it on track last year, but alas I'm having to stomach riding her as she is, poor thing!
There is street view available from the A316, looks like people have hit it before. Sounds like you're gonna have to chalk it up as being unfortunate. As you've said, many councils are now pursuing people for repairs to barriers etc just to rub salt into the wound!
Hope you heal up soon and get your baby back!
