mmmm yes ... i feel your point is valid ... there is still due process and such to go through.... gathering of evidence must be legal format... if someone hands over their camera voluntarily or when asked... and it happens to have some misdemeanour on it .. then more fool them.. but sometimes its whats the 'hot topic' that Something Must Be Done!!! about...
i think the police can ask you to turn the camera off while they stop you ... but its not a law - kinda - you dont HAVE to.. but they might get their really sharp pencils out for writing tickets..... same as if the highway patrol vehicles here now stop you and they are recording via dashcam .. they are supposed to inform you immediately that you are being recorded (though i have been informed twice in 10 years and the rest of the time they didnt - only been pulled up for checks and so on though... no risky activity) , so i dont see why we cant inform them that they are being recorded also .. ?? ..
i also think that depending on how the 'evidence' was collected affects how it can be used in court ... they might go over older footage as a means of providing 'historical behaviour patterns' .. but most of the time its only the current thing you got caught for that you gonna get hit with ..
thinking...... a danger with some of these new cameras... with the built in GPS (and like iphones or other smartphones) ... as i understand it there is a little part of the picture or video that can also record your location etc .. if you know how to find it... on the phones etc you are supposed to be able to turn off/deny permission for tracking data ... with the cameras dont know... its a two edged sword though... "great i can show everyone just where i rode on my vlog today" ... VS .. "oh crap .. EVERYONE will know just what location and speed i was doing at that location on my vlog today!! .. EVERYONE!!!"
thinking again... a Vlogger consistently uploads 'hectic stunts and crazy speeds on public roads' vids.... the law enforcement people cant hit you up after the fact! .. but with enough attention and time they may be able to work out who you are! ... you might pass underneath a traffic monitoring camera at a location in the vid... if the vlogger is noticeable enough through the historical behaviour vids .. then the law 'could' take the time to cross reference your vid info with that of the monitoring camera for a given time period ... "oh yes there he is! bike in left lane doing high speed and swerving in and out of traffic, oh look there is the number plate!" ... from there they 'could' then put your plate details into the onboard monitoring systems that a lot of the cop cars are starting to/carrying now .. its all automatic! .. the onboard electronics can scan plates and such for current rego and so on .. (bit like the lo-jack system) .. you pass a cop car, their system pops up a flag, they wheel around all casual like and follow you along for a bit (back in the traffic) , sooner or later you are gonna get the 'need for speed' ... they catch you doing it live! ... great for them cos now they have it on their video system that records the entire thing including the pull over or chase if you try to run (your plate is still likely to have been captured by their onboard recording gear .. it goes to court because you were having extra fun that day! and lost your licence on the spot , but want to argue the point!?...
In court your old video 'evidence' may or may not be admissable (again depending on how it was collected) .. but the officers say "person is known for having consistent bad behaviour on the roads" .. even if your old vids cant be used in court, the fact that it was stated as being known is gonna count against you a bit! .. if lawyers and such get involved then you can bet your ass that the state lawyer will want you to look as bad as possible! and drag up every little thing youve ever been caught for or officially warned for.
yeah its a long stretch , but with the way technology is now and the amount of cameras mounted around the cities and other major roads .. we think we go around unseen ... (and unless a live person is monitoring that particular feed it is kind of unseen) ... but you are 'on tape' so much!! ..
look at your nightly news now when there is a attack/murder/attempted abduction/break in/robbery etc .. heaps of CCTV shown about how they could see Suspect X passing behind the Victim/Car/Window/whatever .. 'if anybody recognises anything about the person highlighted then please call this number' ..
when the "Gummint" wants to prove a point about how Dedicated They Are To Public Safety, or How Our Police Force Is Doing a Great Job!!, or This Dismissive Behaviour The Youth of Today Display Towards The Law .. then they put their own techies on it and stuff gets found..
Whether or not any of the 'i know a bloke who says his sister goes out with a guy that got busted for XYZ' stuff is true or not... the more times it gets noticed officially or might get taken to court... then the more chance there IS of someone getting charged for it.... then there is a precedent .. which makes the next one easier for THEM!!

really i dont care that much if some Vlogger is gonna upload their 'bad behaviour' .... just so long as if/when they do get caught for something... and any previous vids they also put up that help the law get them charged ... then dont whine about it!! .. you do something and get caught!? ... whose fault is that?! ... only the Vlogger!
