he broke his ankle
It appeared to me that the biker was lane splitting and then pulled in front of the car at the intersection. Not sure if that's legal in AZ or not. In states where it's not the norm to lane split, like Texas, car drivers get mad about it, because they think somehow it puts them in danger (which it doesn't) or they are just mad because they wanted to be "first" and the biker "cheated", like they're in some kind of competition.
What the car driver did, I counted 3 counts of simple assault. The two punches at the biker and the shove on his passenger. The threats he made while on the ground could probably be another assault charge, but it sounds like the State is going with "disorderly conduct" and "threats". All of those are misdemeanor charges, so he probably won't do time, unless he's been a problem for law enforcement in the past. I don't know AZ law, but in Texas, Simple Assault with minor bodily injury (busted lip, black eye) can get 1 year in jail and a fine of $4000. If the guy and girl weren't injured, it would be downgraded to a Class C Misdemeanor and it would just be a $500 fine for each count.
Why the biker was smart for not swinging on him or ground-pounding him while he had him down is that the law would consider that a separate act of assault. Probably a "wash" (nobody gets charged) while they were standing, because the cager could have still been a threat, but the law now considers it "fighting" rather than SD, but once he had the cager down, had he pummeled him, it would have been Aggravated Assault, which is a Felony(2-99 years in Prison, depending upon severity) if convicted! Why? He had him restrained and the guy was no longer a threat. Also, hitting someone's head against concrete is considered using a deadly weapon against him because it can cause death or permanent disfigurement.
And you all know how much the law loves bikers....
By simply restraining him and waiting for the cops, the biker stayed almost unquestionably in the right in terms of the confrontation itself. It's a good example for all of us!
The seminary student here agreesPossessed demonic driver.
Unbelievable... assault whilst DUI, they should throw everything at him. What was that about he won't go to jail because he broke his ankle? Did I read that right? And what the hell was he doing driving in flip flops? That's illegal in many countries, and a stupid choice of footwear for driving or riding.
Bet he still is trying to blame the biker for his injury when he brought it on himself. Absolutely zero sympathy for him.
