Hmm you could have avoided that to the honest fella.

Show that to an insurance company and you'll be forced into a 50/50 claim
 
His road positioning was out. He was quite clearly doing something stupid but you didn't see it coming! Forward planning would have prevented that

Aye UK law. I'm in the UK! Just because something is legal doesn't mean you have to do it!

It's legal for me to walk across the road but you don't see me jumping out in front of cars. It's the same when people hit those walking between buses, do they really need to filter rather than wait 2 minutes for the congestion to clear?

You don't HAVE to filter just because its legal to do so.

Forward planning is easy to say with hindsight BUT yes that is a very valid point. That traffic jam was over 12 miles long (no kidding, started on the Bayswater Road and finished on the M3) there were 100s of cars positioned like that all along the route with drivers attempting to see down the traffic.
But if your saying its fine for someone to swap lanes without indicating, without a mirror check and without a blind spot check well I can't argue with that logic. You have to remember I was in a separate lane at the time if you look at the road markings.

But your 50/50 wouldn't happen I can all but guarantee it would go in my favour but as no harm done it was a case of lets blame each other and move on.

BTW riding in central London, congestion doesn't clear, its just there all day. It's what it is, filtering in town is fine if you keep your speed down and as you point out don't be stupid.

For example filter to get home takes me 45mins, in the car takes 2-3hrs.

But I think what your really saying is bikers shouldn't filter.

That's not what I'm saying at all. I'm saying that you could have possibly avoided the situation, I am not saying you're 100% to blame. The driver was also in the wrong by not indicating but out of everyone else in that lane he stood out quite clearly. IMO you could have seen him and he should have seen you.

Yes you was arguably in the other lane but you were also extremely close to the left lane. You only moved towards the centre of the lane when you noticed him coming out.

I would be surprised if that did not turn out to be a 50/50 claim to be honest. (if you actually claimed). I sold insurance for 6 years and I've worked with some of the major underwriters and brokers in the UK. I've also spent two years working in the claims department of a leading insurer. Long story short if that came through the books we would just flush it (50/50) out unless one of you wanted to take it to court and argue it.

I'm also well aware of living and driving/living in London - It's a dog eat dog place

And back to biker not filtering lol - Nah I love filtering but sometimes there really is a time and place for it.
 
Without getting drawn into an argument between you two, it would be great to hear some more "insurance company" or legal arguments - as a lesson on what to avoid - on who is in the right and who in the wrong and how the courts and insurance see things when filtering.

Its not an argument its a discussion ;)

All I can say if you think / are sure you are in the right go all the way with your claim. Even if that means the courts or threat of. But I don't work in insurance thank god ;)

As for the filtering its changed a lot of recent as Nasty Evil Ninja will tell you and also myself... we have both had filter claims go in our favour full comp. But also dandoolittle is right, its best not to get into that situation in the first place!

Anyway I disagree with Dandolittle he could not avoid it, the audi pulled out when thunderous71 was next to him, while there was no space to go, so the audi waited for the bike to be close to then go about 1m right and stop...
 
It looked to me the Audi driver was being a right c**t and deliberately moved forward when you approached just to stop you filtering. There was no reason for him to be in that position on the road there
 
Personally I'd like to see any further interaction you had with him after he looked up at your cam (only for a laugh). That was unfortunate accident, wrong time wrong place. Personally I think the Audi driver was at fault 99% but thats my opinion.
