Motorcyclist Prosecuted For Careless Riding

I agree. Bullshit. Careless because he overtook the car on the left, because the cager didn't feel like switching to the center lane to allow the biker to pass? You know society is going down the toilet when the law becomes more and more ridiculous. :rolleyes:
 
The A14 is a load of bollocks. if the biker got a ticket for that, then the car should have got one for lane hogging. Bike was clearly doing at or near the speed limit, certainly not at the threshold where they would be handing out a speeding ticket.

Filtering "should" be done at low speeds, and you must not pass on the left unless the lane you are in is moving quicker than the lane to your right. Technically, banged to rights, realistically, a complete crock. He had the space to do it safely (we assume there was plenty of room in front of the car), and he was still travelling at a speed close to the speed of the rest of the traffic.

Normally on the A14 except at rush hour, the cars take both lanes like a ladder at 65mph, for a bike it's easy to work through at 70mph between the cars with acres of space - that's what needs addressing on that road.

I have no problem with the biker getting busted for this. We all know it's wrong, and dangerous but £885 and 8 points is taking the pee. I'd better be much more careful on the Leeds dual carriageway when dix are hogging the outside lane bang on the 40 limit

But they really pee me off
 
Well that just sucks :( I think thats legal here on a multilane hwy so I see nothing wrong with it, Bunch of c**ts for booking him for that

Overtaking and passing
You may overtake a vehicle only if you have a clear view of any approaching traffic and you can do it safely.

You should only overtake when safe and when road markings and signs indicate that you can.

You can overtake a vehicle on the left if:

  • you are driving on a multi-lane road and the vehicle can be safely overtaken in a marked lane to the left of the vehicle
  • the vehicle in front is turning right or making a U-turn from the centre of the road and is indicating right
  • the vehicle being overtaken is stationary and it is safe to do so.
A motorcycle rider may overtake vehicles to the left when lane filtering or riding on a road shoulder or in an emergency stopping lane, in the following circumstances:

  • A motorcycle rider with an open licence for riding a motorcycle may lane filter by moving between stationary or slow moving vehicles travelling in the same direction as the rider, provided they are riding at not more than 30km/h and it is safe to do so. Lane filtering is not permitted in school zones during school zone hours. Lane filtering at speeds higher than 30km/h (sometimes known as lane splitting) is prohibited.   • A motorcycle rider with an open licence for riding a motorcycle may ride at speeds not greater than 30km/h on sealed road shoulders (or in emergency stopping lanes) to the left or right of an edge line on roads with a speed limit of 90km/h or more, such as motorways, freeways and highways, provided it is safe to do so. In no other situation should the driver of a motor vehicle overtake on the left.
 
Look - yeah this punishment is ridiculous, it really is over the top and I don't understand it. Sadly the video is edited and we can't see the whole story.

I have to say though:
  • He and the car were clocked at 68 when he decided to overtake the "slow" car in the right lane... I don't consider 2mph under the limit to be really taking the piss.
  • This is a 2 lane section, the left hand lane is a merge lane
  • The "slow" car was actually in the process of overtaking the car to it's left - was it supposed to just shunt it out of the way so the rider could pass?
  • He did not use his indicators on any of his lane crosses (come on now we all HATE it when cagers do that...)
  • Does he not use his mirrors? There was a police car right behind him!!
So in my opinion the rider was impatient, and that's a killer on the roads...

I also have to say that the police did not need to pull him over where they did, leading to an incredibly dodgy decision of the rider to duck in front of a lorry and across a merge lane which he was blind to. They had the footage, they could have followed him to a safer place.
 
If he had indicated and moved to the middle lane, passed the black car then indicated and moved to the outside lane that would have been less 'reckless' to me. It does look as though he has just sped around the black car. I see motorists indicate once and cross over 2-3 lanes at once - that's reckless! This guy I wouldn't put in the reckless category but he still (as annoyed as he may have been) could have approached this situation differently.
 
Luckily here in my state, there is no law saying that you have to keep on the outside unless to pass, so we can be in any darn lane we want :p !

4C Passing

4C-1 It is unlawful to:
♦ Pass in any marked no-passing zones.
♦ Exceed the posted speed limit when passing.
♦ Pass a school bus with flashing red lights and stop arm extended.
♦ Pass within 100 feet of any intersection.
♦ Pass within 100 feet of any railroad crossing.
♦ Pass on any hill, curve or bridge where vision is obstructed.

4C-2 How To Pass
♦ Decide if it is necessary to pass.
♦ Stay at least 3 seconds behind the vehicle ahead.
♦ Signal and check all around your vehicle before passing.
♦ Increase speed and pull into the passing lane.
♦ Signal and move back into the right lane when the front of the vehicle being passed or vehicles’s headlights are seen in the rear view mirror.
♦ Resume speed.

4C-3 When Being Passed
♦ When another vehicle is passing, stay in the lane and maintain speed unless there is an emergency.
♦ In an emergency, speed up, slow down, or leave the road to prevent a crash.

4C-4 Passing Parked Cars When driving past parked vehicles, watch for vehicles pulling out. Check for clues such as:
♦ Exhaust coming from the tail pipe.
♦ Brake lights on, turn signal flashing, or white back-up lights on.
♦ Front wheels turning out toward traffic.
♦ Person seated in drivers position.
♦ Watch for people or animals emerging from between parked vehicles.

Reading the description, the dude should have attended court. Maybe pleaded guilty to failing to indicate. Instead he didnt show and was fined + court costs. Im surprised that the police posted the video... a pretty insignificant video that does nothing good for them.
