Copyright On Memes And Other People's Vids?

with plenty of funny motorbike related memes around i've been including these in the vlogs as a bit of comedy relief. i like to try and do the right thing by getting permission to use other people's stuff, or at least acknowledging them but trying to track down the author of a meme seems impossible.

anyone facing similar copyright issues? do you just go ahead but put a small bit of text somewhere in the vid explaining you couldn't source the copyright owner but inviting them to contact you and you'll acknowledge them with a video annotation?

probably not a big issue as i think most guys are just happy to see their memes spread but figure it's nice to do the right thing....

Given the number of online "Meme Generators" available, it'd be almost impossible to find out the 'true' originator of one..

So just do one yourself. Even if if looks remarkably similar to one you've already seen ;)
 
At one point Cheezburger tried to claim a trademark on the Rage Faces used in countless comics and videos. It failed. So far, I don't think anyone has been able to prove ownership of these or any popular memes.
 
cheers guys, i reckon i'll just plod on the same way but make more of my own memes too. i've got photoshop so can do a tidier job than the generators usually. just thought someone out there might ahve used a meme and had the creator complain, would have been interesting to know how it panned out.
 
using an image in your video for under five seconds is easily considered fair use if it's for comedy.

actually that raises an interesting point, the four key points that can allow an exception to copyright in most countries if.....
  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.
 
Meme well the slogan etc is very hard to copyright but the image used not so, I would be more worried about the image in use even if from a Meme generator.

hmmm. i do quite a few training vids so maybe when where's one about learning to relax before an enduro competition i could use that one lurch. :D
