copyright music in videos

Hey all,
just wondering what the deal is with putting copyrighted music in YouTube videos... I am working on a video now that really needs the two songs i have chosen, one is from a 1970ish movie and the other is a classic rock song. both were at one time very popular songs but i feel i really need them in the video to keep my "artistic intent"...haha. Anyway, If i keep the video as not monetized, I am safe to use these? I have heard somewhere that if the songs are over 15 yeas old, copyright laws are no longer in effect. Anyone know if this is true?
Neither of them are a part of the intro, both are somewhere in the middle of the video and i did not ask anyone for permission to use these songs. Also, should i note that i have copyrighted material in my video or will this only add unnecessary attention to my video? I put a lot of time into the video and really don't want it to get pulled... I am just not sure of the details on how YouTube handles these things, any input is appreciated Thanks!

Usually when you attempt to monetize your video they will/would pick up on any copyright material on the spot, often flagging things for copyrighted music when they don't actually know where it's form.

I highly doubt you will be able to make it through the barrier, at least every single time I have tried I've been picked up on it, the only issue I've had as a non-partner with monetization is that they removed revenue from that video. However for full partners it may be a different story. It all depends whether you're under Youtube's partnership program, or just have revenue sharing enabled.

This is why I never bothered to get involved with adsense or partnership programs - what little money I might make isn't worth the censorship. I make videos for myself (memories) and my friends entertainment, and having the music is more important than the couple bucks.

Now if I had thousands of sub's and videos that were actually good, maybe I'd feel differently, IDK..... :lol:

There is a good choice of copyright free music at Jamendo (http://www.jamendo.com). It really is worth picking copyright free stuff, it makes everything much easier

thank you all for the insight, looks like I will be playing it safe rather than sorry. i'd hate to get a video banned just because of the music i picked...I think i will render the portion of my video with the copyrighted music before i rework it and and post that on my Facebook page as a "director's cut" sort of thing.

And how do you go about getting permission? I think that's more of the problem, the average person doesn't know how to obtain that info. I just make sure I show a credit to the artist in both the video and in the video description.

What's funny, is that the masterful YouTube picked up on a song playing on Britex's Goldwing radio in the background, and automatically linked to Apple's iTunes store.

It seems to be if its on iTunes you can get away with using it but not to monetize.

well i put the video on YouTube and i did NOT use any copyrighted music. but, i tried uploading a "directors cut" clip from the video (with the copyrighted music) to my facebook page and the facebook people nailed it before it even finished uploading. they basically said if i tried it again they would ban my page THEN, this morning i got an email from YouTube asking for me to verify that i have the rights to the royalty free music i used in my video.
its kind of ridiculous...i mean i am just doing this for fun...i swear lawyers are going to destroy this planet...

hey all just thought i'd share the video and tell you about how much better it would have been with the music i really wanted

the redneck scene was originally edited with "Dueling Banjos" from the movie deliverance, with the escape scene during the fast part of the song- it was all timed together with the music and very fitting-i really hated to swap that song out...

the vloggercross preview originally had "for those about to rock" by AC/DC, also synced with the video events. i had to re-do that whole portion of the video; changing the song really messed with the mood of things.

before i swapped the music out i had already done a ton of editing and really did not want to risk the video getting taken down... it is bothersome that YouTube is messing with my creativity in a sense, but i would have been much more upset if it would have got my video pulled. but, all in all i think it turned out well.

Anyway thank you all for your help with this! and i really appreciate all you guys!

This seems to work and I don't monetize at all but YT stuck ads on because of the music. Royalty Free can get whacked too if you don't give the artist credit. Most sites tell you how to do that.
