Well it's easy to judge other people's riding when sat in front of a computer and able to re-watch the video multiple times. But as you asked....
The driver obviously didn't look or signal his intention to move out. I think he was at fault. But, (there's always a but) if you had been more
observant, you would have seen the bus stopping and could have made a reasonable guess that he might try to pass the bus. In which case,
hold back until you know what he's going to do. Remember, it wouldn't matter who's fault it was if he side swiped you into a lamppost, a parked
car or worse, an oncoming vehicle.
We all make mistakes. The trick is to learn from them.
p.s. You were very calm and forgiving with him. Plenty of others wouldn't have been
One thing - an observation from somewhere filtering isn't allowed:
If filtering became allowed I would expect it would take for-ever (if you're lucky!!) for drivers to add the extra mirror and head observations required to allow for the new positions bikers may appear from. It would be the same for pedestrians, as displayed already in a couple of vids by Pickle-poo and entoptika where peds walked out in front of them when they were filtering.
For that reason I think the bikers who will only filter at low speed have the right idea because there is no way you can expect an already lazy and un-observant species (humans) to properly cope with looking for bikes on the "wrong" side of the road etc.
Van driver definitely at fault, but there was some risk taken by yourself in the speed and situation of the pass.
