Cop rear-ends motorcycle and blames the rider!!!

I would have ripped that officer a new arse!

I had to watch it a couple of times, but WTF. That cop is using intimidation and Gestapo techniques to get away with a heap of trouble. The rider's helmet cam clearly shows the merging car moving over and traffic ahead slowing down right before speeding back up as the cop hits him. The biker didn't even hit his brakes hard. The cop just expected the biker to zip ahead instead of slowing even more. I hate it when people change lanes on my rear tail like that.

No excuse for that cop's behavior in that situation.
 
Rider did the right thing at the time in the video. Arguing with the officer will only make things worse. Best course is to just say 'yes sir' and go on your way, then call a lawyer and sue the department for damages, as well as reporting the incident to the police chief and the local news agencies (might be wise to get permission from a lawyer on that one though.)
 
No, it wasn't me. I just wanted this video to circulate around the internet so the cop's supervisor could see the video.
 
Would anyones thought process be to not argue with the cop, let him say whatever, then when he leaves, call 911 and report a hit and run? Technically if the cop left.. it IS a hit and run...

Actually it's not a hit and run. The officer got out, checked on the rider, and both agreed to part ways. calling 911 would be ineffective, and probably cause undue trouble for the rider. Cops typically look out for each other, especially when they're in the same jurisdiction. Adding another officer to the issue just makes it a 2 on 1, rather than a 1 on 1. Then all they have to do is seize the memory card of the camera in the name of evidence, and the rider is left without a leg to stand on.

Instead the rider did it right, went home, and then lawyered up. You don't fight the system by arguing with the peons, you fight it by going after the upper management, which is basically what's about to happen. Bad press is one of the individual officer's biggest enemies.

I have a feeling the lawsuit will do a lot more damage than sitting on the side of the road arguing with the guy. It's very possible that he'll lose his job after this one, and the rider might even receive punitive damages of some sort from the department.

Yea, you're right, however, the biker doesn't *know* his bike was fine, he never even had an opportunity to check, the cop asked if he was ok, and then left...

Once the officer calmed down, near the end, he could have said 'No, I need to make sure my bike is still ride-able.' He probably -should- have gotten off the bike and checked, but he was there and we weren't, so it's possible that he had a pretty good idea that the bike was fine.

exactly thats why I put the *'s there, since he probably knew he was fine, just a hypothetical. Like I said, you're right, not to try and pull the hit and run stuntacular.
 
1. I showed this to my two cousins earlier today when LJ first put it on Facebook, they are both cops and one is a police chief, they both said the cop was at fault.

2. Aren't cops supposed to check for license and insurance at every incident be it traffic stop or wreck? Hell last time I got pulled over the officer checked my stuff and asked for the ID of everyone else in the car too. Why didn't he?

3. I wish the rider would have dismounted and asked for him to wait while he inspected his bike for damage then asked for an accident report just in case for his insurance company. Cop would have been sh****ng himself!

4. If he would have become any more beligerent or verbally harrassing I would have loved to see what happened when a supervisor was called to the scene. Could backfire....supervisor could have sided/protected his officer.

Seriously? You're now supposed to be aware of every lane change that's happening behind you? Cop knew he should have given the bike more room in case the bike had to stop suddenly for any reason (like a kid running into the road). Biker played it right. Not sure I could have handled it so well knowing I'd done nothing wrong, but then I'd be in cuffs and he got to go home.
 
From FaceBook: "This just in from my Attorney Stephen Stubbs. Officer Gene Holm has been "relieved of duty" (but not fired yet) pending the results of the investigation. Tell whomever you want. That was fast. This must not of been his first time."

There's no love lost between normal cops and Internal Affairs. I'd bet that once their investigation is over he'll have a hard time getting a job as a cop anywhere, and he most likely won't have the one he's got now. Either way he's definitely off the streets at the moment.
