Bad Customer Service....

Should I raise a dispute now or wait for the seller to respond?

So I ordered some new silencers for my Guzzi last month with an expected delivery date of the 17th which passed so I contacted the seller requesting tracking details which they avoided doing for almost a week of me asking daily. Eventually I get them to give me the details and the silencers turned up yesterday and were not the ones I ordered. I've contacted the seller and they offered me a 30% discount on them if I keep them which isn't an option unfortunately as I need shiny metal, not matte-black, they alternatively suggested I send them back and they would then send me the correct parts. Again, this is no good to me as they only offered to cover up to a certain price on the return shipping. I've since given them a counter offer of they courier the correct parts to me by the end of next week and the courier collects the black cans.

Anyhows, that is the background and where I am up to with them.

My issue is that they have continuously lied or avoided giving me information regarding the sale and are very slow to respond to messages. Should I raise a dispute via ebay or should I wait until they respond to my counter offer?
 
I'd say get eBay to mediate. Have everything go through eBay as a third party to witness it all. You don't have to get all salty and edgy when dealing with the seller, just be firm, polite and cordial in sorting out the mess. But it's always nice to have someone looking on so it's not your word against his.
 
Open a dispute, to make sure you don't end up screwed. I'd check If i can sell them locally to cover my losses, as most ebay sellers don't wanna deal with returns at all.
 
Dispute their asses via eBay. Request for FULL refund. It's not your fault they sent the wrong stuff, why should you have to pay for the return shipping. Once eBay gets involved via the dispute case you should be safe.
 
ebay sided with the seller, saying I received the item even though it clearly has a different part number to what I ordered. Am currently trying to dispute through PayPal as ebay failed me
 
Hmm, that is quite disappointing with eBay siding with the seller, in that case sellers can just ship random stuff to the buyer and just say "sorry! too bad!" and eBay will say "hey since you *did* get something from the seller so it's ok, seller wins!".

That's so bullshit.

Edit: On a side note, you should make a video of this, and about eBay, and share it out. eBay messed up royally in my opinion. Include all the proof in your video to make a your stronger case/point valid.
 
I am tempted to but I want the issue sorted first as bad publicity could cause more issues with trying to get my money back
 
Unfortunately they are no longer offering the 30% discount.... but I have spent a lot of money and effort on my Guzzi V7, I don't want bodged items on it, if I can't have the Mivv cans I want then will go with my straight through unsilenced cans as although they are obnoxious, I like them fine. Just want my money back on theses junk Mivvs
